What rights do I have as an employee or as someone applying for a job?

  • You cannot be discriminated against based on race, color, religion, sex, or national origin.
  • Employers cannot discriminate based on age and cannot discriminate against pregnant women or qualified individuals with disabilities.
  • You have the right to equal pay for equal work, regardless of your gender.
  • Your employer cannot discriminate in any area of employment including hiring, firing, pay, assignment, transfer, promotion, layoff, recall, fringe benefits, retirement plans, leave or any other terms or conditions of employment.

What should I do if I think someone has harassed or discriminated against me?

First, contact an attorney. D'Angelo & Hashem can determine if you have a legitimate case against the other individual or company. If you do, we can help you file a charge of discrimination with the Equal Employment Opportunity Commission (EEOC), ensure that you file it within the allotted time frame, and help you recover the damages you deserve.

What if I see a co-worker harassing another co-worker? Should I report that?

You can file a charge on behalf of someone else, if they want you to. In doing so, you are also protected - it is illegal to retaliate against an individual for filing a charge or discrimination, taking part in an investigation or opposing discrimination or harassment practices.
